Terms of Service

The rules for using Conejo Survey, written to be readable without hiding the important parts.

1. Acceptance of Terms

By creating an account, clicking to subscribe, or otherwise using Conejo Survey, a service provided by Market Action Research, Inc. ("Conejo Survey", "we", "us"), you agree to these Terms of Service ("Terms"). If you use the Service on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Service

Conejo Survey is a hosted survey and feedback platform that lets customers create surveys, collect responses, build survey chains, share links and QR codes, and view dashboards and exports. Features vary by plan, and we may improve, add, or remove features over time.

3. Accounts and Security

  • You must provide accurate, current information when creating an account.
  • You are responsible for safeguarding your credentials and for activity under your account.
  • You must be at least 18 years old to use the Service.
  • You agree to notify us promptly if you believe your account has been compromised.

4. Subscription, Billing, and Auto-Renewal

  • Free tier: We offer a free plan with usage limits described on our plans page.
  • Paid tiers: Paid plans are billed monthly or annually through Stripe. By starting a paid subscription, you authorize recurring charges until you cancel.
  • Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel before renewal.
  • Cancellation: You may cancel from your billing settings or by contacting support. Paid features remain active until the end of the current billing period.
  • Refunds: Fees are non-refundable except where required by law. Partial billing periods are not prorated unless we expressly say otherwise.
  • Taxes: Prices shown on the Service may not include applicable taxes, duties, or similar government charges. You are responsible for those charges except for taxes based on our net income.
  • Downgrades and limits: Downgrades take effect at the end of the current billing period. Existing data is preserved, but you may be blocked from creating new resources or using paid features above your new tier's limits.
  • Failed payments: If payment fails, we may retry charges through our payment processor, suspend paid features, or cancel the subscription if payment remains unresolved.
  • Price changes: We may change pricing in the future. We will give reasonable advance notice before a price change affects your next renewal.

5. Customer Responsibilities and Acceptable Use

You are responsible for your use of the Service and for the legality of the content and data you collect. You agree not to:

  • ×Use the Service for unlawful, deceptive, infringing, or abusive activity
  • ×Collect personal information from respondents without any required notices, consents, or lawful basis
  • ×Upload malware, spam, phishing content, or content that interferes with the security of the Service
  • ×Attempt to scrape, reverse engineer, bypass access controls, or exceed your plan limits in bad faith
  • ×Impersonate another person or entity or misrepresent your affiliation
  • ×Use the Service to collect or store full payment card numbers, bank account credentials, Social Security numbers, government ID numbers, medical or health information, biometric identifiers, or other sensitive or regulated data unless we expressly agree in writing
  • ×Use the Service in a way that would require us to be subject to HIPAA, GLBA, FERPA, COPPA, or similar sector-specific obligations unless we have separately agreed in writing

6. Your Content and Feedback

You retain ownership of the surveys, questions, uploaded assets, and response data you create or collect through the Service ("Your Content"). You grant us a limited, non-exclusive license to host, process, transmit, display, and back up Your Content only as needed to provide, secure, support, and improve the Service.

You represent that you have all rights and permissions needed to use and submit Your Content to the Service. We do not sell Your Content or use it for advertising.

If you send us feedback or product suggestions, we may use them without restriction or compensation to you.

7. Data Processing and Privacy

Our handling of personal information is described in our Privacy Policy. For your account, billing profile, and our website analytics data, we generally act as an independent business/controller. For survey response data you collect using the Service, you are generally the controller/business and we act as your processor or service provider.

8. Service Availability and Changes

We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free access. We may perform maintenance, release updates, change features, or discontinue parts of the Service. Some features may be labeled beta, preview, or AI-assisted and may evolve more quickly than the rest of the product.

9. Suspension and Termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created a security risk, failed to pay applicable fees, or used the Service in a way that could create legal exposure for us or others.

You may request deletion of your account at any time by contacting support. Unless we need to retain certain records for legal, tax, security, or dispute-resolution reasons, account data is deleted within 30 days after confirmed deletion.

10. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Conejo Survey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption.

Our total liability for all claims arising out of or relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Market Action Research, Inc. is incorporated in California, and disputes arising from these Terms will be resolved in the state or federal courts located in Ventura County, California.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and may also notify you by email or through the Service. Continuing to use the Service after the updated Terms take effect means you accept the revised Terms.
